Alan M. Dershowitz—Is Sally Yates A Hero or a Villain?: 

Acting Attorney General Sally Yates was fired by President Donald Trump because she instructed the Justice Department lawyers not to defend Trump’s Executive Order regarding travel to the U.S. by people from certain Muslim countries. She is neither a hero, nor a villain. She made an honest mistake when she instructed the entire Justice Department not to defend President Trump’s wrong-headed executive order on immigration. The reasons she gave in her letter referred to matters beyond the scope of the attorney general. She criticized the order on policy grounds and said that it was not “right.” She also referred to its possibly unconstitutionality and unlawful. Had she stuck to the latter two criteria she would have been on more solid ground, although perhaps wrong on the merits. But by interjecting issues of policy and directing the Justice Department not to defend any aspect of the order, she overstepped her bounds.

An Attorney General, like any citizen, has the right to disagree with a presidential order, but unless it is clear that the order is unlawful, she has no authority to order the Justice Department to refuse to enforce it. This order is multi-faceted and complex. It raises serious constitutional and legal issues that deserved nuanced and calibrated consideration from the nation’s highest law officer. There are significant differences between the constitutional status of green card holders on the one hand, and potential visitors from another country who are seeking visas. Moreover, there are statutory issues in addition to constitutional ones. A blanket order to refuse to defend any part of the statute is overkill. If she strongly disagreed with the policies underlying the Order, she should have resigned in protest, and left it to others within the Justice Department to defend those parts of the Order that are legally defensible.

I, too, disagree, with the policy underlying the order, but I don’t immediately assume that any policy with which I disagree is automatically unconstitutional or unlawful.

The President has considerable constitutional authority to control entry into the United States by non-citizens and non-residents. Congress, too, has some degree of control over our borders. The precise relationship between presidential and congressional power has never been defined by the Supreme Court. A more responsible Attorney General would seek to analyze these complex issues before jumping into the political fire by a blanket refusal to defend any part of the order.

I don’t know.

I think this is a better question: what was Sally Yates trying to accomplish?

From where I sit, Yates looks like a run-of-the-mill scumbag Democrat lawyer who used every smidgen of authority she had to obstruct the Trump agenda regardless of the law.

Does that make Yates a villain?  From the Democrat point of view, the answer is no.  In their eyes, she’s a hero.

This is just week 3 of Trump’s presidency.  Things are only beginning to heat up.  It will get a lot worse going forward.

Switching Gears

Wait until President Trump announces his decision to move the U.S. embassy in Israel from Tel Aviv to Jerusalem.  That’s when the excrement will hit the fan.  People need to prepare for that one.

There is no question in my mind that moving the U.S. embassy to Jerusalem is the right thing to do.  After all, Jerusalem is Israel’s capital and the seat of her government.  Even more important, though, Jerusalem is the only city in the world about which Yahweh said, “My eyes and My heart will be there forever.”

Jerusalem is the city that Yahweh chose to be Israel’s capital about 3,000 years ago.    It’s where Yahweh’s Temple stood, twice.  It’s where the Messiah was crucified and buried.  It’s where Yahweh will rule when He returns for the thousand year reign.

Jerusalem was Israel’s capital long before the word “Palestinian” was conceived.  The notion of “Palestinians” but not the word “Palestinians” originated in about 135 A.D. after the Romans put down the Bar Kochba Rebellion.  It was intended as an insult to the Jewish people who lived in Israel because the word they used was “Philistine”.  It morphed into Palestine over time.  Actually, Philistine is more correct.

In 1948, everyone who lived in Israel was called a Palestinian including Jewish people. Below is a poster urging Jewish people to return to the Promised Land to help build the country Israel.

In 1964, Yasser Arafat, an Egyptian, commandeered the word “Palestinian” and applied it to a hodgepodge group of malcontents that no Arab country wanted and sold the lie to the world that they were displaced souls.  He presented Israel to the world as the aggressor that refused to allow them to live in their ancient homeland.

Everything Arafat said was a lie, but the world bought all of them.  So, in a nutshell, so-called “Palestinians” have no claim on the Promised Land.  The lie that they do dates back about 50 years, not since time immemorial as they claim.

This is a funny story.  Katie and I were hiking in the Valley of Elah with two of our dearest friends.  We were looking for the site where David was when he was given permission to fight Goliath.  As it turned out, we were on the other side of the valley, and we walked up on a sign that explained we were standing where the Philistines were when they were hurling insults at the Israelites.

Chen and Noam are Israeli.  Chen read the sign in Hebrew, and he used the English word “Philistine” to explain what it said.  Later, he used the word “Philistine” again to describe Palestinians.  He didn’t use the word in a pejorative manner.  He was just being precise.

This is the point: the people we refer to today as “Palestinians” are actually “Philistines”.  It’s accurate, and it fits.

Be that as it may, moving the U.S. embassy in Israel from Tel Aviv to Jerusalem will be a thorny issue.  Democrats will have a conniption fit when that day comes.  They will rally their forces and take to the streets—again.

Get ready because I have a strong hunch that there will be blood.  Democrats will finally get the violence that they have been provoking for.
